These Terms of Service (“Terms”) govern your access to and use of the websites, mobile applications, and related services offered by GAME360, LLC. (“GAME360,” “we,” or “us”) (collectively, the “Services”). By creating an account, downloading our app, or otherwise using the Services, you agree to these Terms.

1. Eligibility and accounts

You must meet the minimum age and any jurisdictional requirements shown in the app or on our site to use the Services. You are responsible for maintaining accurate account information and for safeguarding your credentials. You are responsible for activity that occurs under your account.

2. The Services

We provide a platform for skill-based games, matchmaking, and related features. We may modify, suspend, or discontinue any part of the Services with reasonable notice where practicable. Certain features may be subject to additional terms presented at the time of use.

3. Acceptable use

You agree not to:

  • Violate applicable law or third-party rights;
  • Cheat, manipulate outcomes, or use unauthorized automation;
  • Attempt to probe, scan, or test the vulnerability of our systems;
  • Harass, threaten, or harm other users;
  • Resell or redistribute the Services without our written consent.

We may investigate violations and take action, including suspending or terminating accounts and cooperating with authorities.

4. Fees, payouts, and taxes

Fees, entry costs, and payout rules are described in the app and may change with notice. You are responsible for any taxes associated with your use of the Services. Payment processing may be provided by third parties; their terms apply to those transactions.

5. Intellectual property

The Services, including software, branding, and content we provide, are owned by GAME360 or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may not copy, modify, or create derivative works except as allowed by law.

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAME360, LLC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

8. Indemnity

You will defend, indemnify, and hold harmless GAME360, LLC. and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms.

9. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or for other operational reasons, with or without notice where permitted by law.

10. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where GAME360 is established, without regard to conflict-of-law principles, except where mandatory laws of your country of residence require otherwise. Venue for disputes will follow applicable law and any supplemental terms shown in the app for your region.

11. Changes

We may update these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. If changes are material, we will provide additional notice as required by law. Continued use after the effective date constitutes acceptance of the updated Terms.

12. Game360 Agent Program

The Game360 Agent Program (“Agency”) lets eligible users facilitate coin trades, earn commissions, and access agent tools. By applying to become an agent or using agent features, you also agree to this section.

  • Agent status is granted at our sole discretion after identity and eligibility review. We may approve, reject, suspend, or revoke agent access at any time, with or without notice, for compliance, risk, or operational reasons.
  • You are responsible for your conduct as an agent, including chat communications, payment instructions, pricing/markup choices, and compliance with applicable laws (including anti-fraud and know-your-customer obligations where they apply to you).
  • Commission rates, funding rules, float requirements, and payout timing are described in the app and may change with notice. We do not guarantee any minimum earnings, trade volume, or continued availability of the program.
  • You must provide accurate identity and address documents. False or misleading applications may result in permanent disqualification and account action.
  • Agents act as independent participants on the platform, not as employees, partners, or legal representatives of GAME360, LLC.. You may not bind GAME360 or make warranties on our behalf.

13. Coin marketplace trades and dispute resolution

Peer coin trades with agents use in-platform chat, escrow, and optional dispute tools. By initiating or accepting a trade, you agree that:

  • GAME360 provides technology to match parties, lock/release escrow, and route disputes to our operations team. We are not a bank, payment institution, or guarantor of any off-platform fiat transfer.
  • You are responsible for verifying payment proof, bank details, and counterpart identity before releasing coins or confirming payment.
  • When a trade is reported, it may be frozen while we review evidence. Our decision on a dispute is final for platform purposes and may include completing, cancelling, or otherwise closing the trade and releasing or refunding escrow as we determine appropriate.
  • To the maximum extent permitted by law, GAME360, LLC. is not liable for losses arising from user error, off-platform payments, chargebacks, delays by third-party banks, or disputes between buyers and agents. Our aggregate liability relating to a specific coin trade is limited as set out in Section 7 above.
  • Abusive, fraudulent, or bad-faith dispute reports may lead to account suspension and forfeiture of agent privileges.
